OFFICIAL RULES

Contest ENTITLED “Transitions Keep your eyes on the ball” organized by Transitions Optical Limited
and Golf Canada.

1. ORGANIZER.

The Contest is organized by Transitions Optical Ltd. and Golf Canada (the “Organizer” or the “Contest Organizer”).

2. CONTEST PERIOD. The Contest will take place over the following period (“Contest Period”):

Time: 11:59 am (Eastern Time)

3. ELIGIBILITY

This contest is open to any person who resides in Canada who is 18 years of age or over. 

Are excluded: directors, officers, executives, employees, agents and representatives of the Organizer, of Facebook and Instagram if the Contest is held on Facebook and/or Instagram, advertising and promotional agencies, suppliers of prizes, goods and services in connection with this Contest, and persons with whom they are domiciled (whether related or not).

4. HOW TO ENTER

Enter the contest by:
Electronically completing and submitting the entry form available on the web site 
UltimatelyKananaskisExperience.com before August 28, 2022 at 11:59 p.m. local time Montreal (Quebec). All of the fields are mandatory. 

5. PRIZES

1)    Pair of Transitions lenses
The winner will receive a gift certificate to the optical clinic of their choice, which sells Transitions lenses. The pair of glasses with Transitions lenses must be ordered before December 31, 2023. Price not redeemable for cash or exchangeable for a credit or other form of prize.

4)   Golf trip for 4 to Kananaski in Alberta 

Airfare for four (4) from a major Canadian airport to golf destination, 2-3 nights accommodation (double occupancy) Fri-Sun or Thu-Sun, Rental car (if necessary), Two (2) rounds of Golf. The trip must take place before October 31, 2022. Prize not redeemable for cash or exchangeable for a credit or other form of prize.

6. DRAW

The winner will be drawn at random from among the contest participants. The draw will take place on Tuesday, August 30, 2022.

7. PRIZE CLAIMS

To claim a prize, participants must:

    1. Be reached by email, at the Organizer’s sole discretion, within 14 days of the end of the Contest;
    2. Sign the declaration and waiver of liability form, which will be forwarded to them by the Organizer and return it to the Organizer within one day of the date of receipt;
    3. Have answered the mathematical skill question correctly and without any help whatsoever, including mechanical or electronic help;
    4. Upon request and on time, provide photo identification.
    5. Claim their Prize by sending an email to cscanada@transitions.com within one day of signing the declaration and liability waiver form at the participating clinic;

Once these steps are completed, the Participant will be declared the winner of the Prize.  

Failure to comply with one of the conditions mentioned in these rules or accept the Prize will disqualify the selected Participant. In such a case, the Contest Organizer will cancel the Prize.

Refusal to accept a prize. The refusal of a selected participant to accept a prize under the terms of these Rules releases the Contest Organizer from any obligation related to the Prize to that person.

Awarding of prizes. No prizes will be awarded without confirmation of a winner. No prize is transferable. It must be accepted as is without cash substitution or otherwise. 

Fee for prize claims. All costs or expenses incurred by the winners in connection with the claim or use of a prize are the responsibility of the winners.

Limited prizes. In all cases, the Contest Organizer may not be required to award more prizes or to award a prize otherwise than in accordance with these Rules.

8. TERMS AND CONDITIONS

Disqualification. All documents related to the Contest, including, but not limited to, the entry forms, scratch cards and declaration and waiver of liability forms are subject to verification by the Contest Organizer. Entries with errors will not be eligible, nor will entries that are incomplete, illegible, mutilated, fraudulent, deteriorated, misprinted or that have been tampered with, altered, falsified, reproduced or obtained illegally.  Participants who have not complied with these Rules may be excluded from this Contest and from any contests or promotions that the Organizer will hold in the future, including, without limitation, any participant found or suspected of: (i) tampering with entries or materials, the processing of entries, the operation of the Contest or any technical or mechanical component of the Contest, or (ii) deliberately damaging the websites, web pages and applications related to this Contest or tampering with the legitimate operation of the Contest, or (iii) violating these Rules, or (iv) using any means that is contrary to these Rules or that is unfair to other participants, or (v) having obtained entries beyond the permitted limit, or (vi) having used multiple names, identities, email addresses and/or any automated system or program to register or participate in the Contest, or (vii) having disrupted the operation of the Contest in any other way, or (viii) having acted unfairly or in a manner that harms or with an intention to annoy, torment, threaten or harass another person.  THE PARTICIPANT OR ANY OTHER PERSON WHO DELIBERATELY ATTEMPTS TO DAMAGE A WEBSITE, EQUIPMENT, APPLICATION OR TECHNOLOGY USED IN CONNECTION WITH THE CONTEST OR TO UNDERMINE THE LEGITIMATE EXPLOITATION OF THE CONTEST COMMITS A CRIMINAL OFFENSE AND A CIVIL OFFENSE AND THE ORGANIZER RESERVES, IN SUCH CASE, THE RIGHT TO DENOUNCE THIS PERSON TO THE JUDICIAL AUTHORITIES AND TO DEMAND FROM THAT PERSON ALL DAMAGES THAT THE LAW ALLOWS HIM OR HER TO CLAIM.

Declaration and waiver of liability form. By participating in or attempting to participate in this Contest, any participant selected for a prize shall relieve the Contest Organizer, its parent company, any corporation, trust or other legal entity controlled by or related to the Contest, any participating clinic, Régie des alcools, des courses et des jeux, Facebook, and Instagram if the Contest is on Facebook and/or Instagram, advertising and promotion agencies and suppliers of prizes, goods and services as part of the Contest as well as all their directors, officers, owners, partners, employees, agents, representatives, successors and assigns (collectively the “Releasees“) for any damages and liability relating to the Contest (participation, operation, announcement, rule, etc.) or to the Prize (claim, use, etc.). 

Limitation of liability. Without limiting the generality of the foregoing waiver, the Releasees will not be liable for (i) any typographical (or other) errors contained in the Offer or documents relating to the administration of the Contest, including, without limitation, errors in advertising, the Official Rules, the announcement of winners, the awarding of prizes or technical malfunctions, problems or difficulties with networks, telephone lines, SMS messaging systems, any computer component, software or communication lines, in connection with the loss or lack of network communication or any transmission that is faulty, incomplete, incomprehensible or erased by any computer, server or service provider or any software, virus, computer bug, failure of personal computers, or configuration of software and hardware, or failed attempts to transmit any email to the Contest Organizer or Participant for any reason, including network congestion or failure of any site that may limit any person’s ability to participate in the Contest; (ii) any late, lost, stolen, delayed, unreceived, damaged, misrouted, incomplete or inaccurate entries; (iii) any failure to receive entries due to transmission problems or technical malfunctions of any kind, including, without limitation, malfunction of any network, servers, access providers, hardware or software, whether originating with the sender or recipient, which may limit or prevent any person’s ability to participate in the Contest; (iv) any damage that may be caused, directly or indirectly, in whole or in part, in particular to the participant’s or any other person’s system or device, by the downloading of any Internet page or software or otherwise, and by the transmission of any information relating to the Contest.

Online registration platform: The Contest Organizer does not guarantee that access to or use of the Contest Website, the Facebook page on the Facebook platform or the Instagram page on the Instagram platform will be uninterrupted during the Contest period or without error.

Cancellation, suspension or modification of the Contest. The Organizer reserves the right, in its sole discretion, to cancel, terminate, modify or suspend, in whole or in part, this Contest in the case of an event that disrupts the proper conduct of the Contest, such as a difficulty in the computer system to record all entries, or any human intervention that could alter or influence the administration, security, impartiality or conduct of the Contest as provided for in these Rules, and this, subject to the approval of the Régie des alcools des courses et des jeux du Québec, if required.

End of the Contest. Should the Contest be terminated in whole or in part before the end of the Contest Period, a random draw may be held, at the discretion of the Contest Organizer, from among the eligible entries duly registered during the Contest Period or, as the case may be, up to the date of the event that terminated the Contest.

Personal data. By participating in the Contest, participants consent to the collection, use and disclosure of their personal data by the Organizer and/or its authorized agents for the purpose of administering the Contest and awarding prizes. By accepting a prize, any Winner authorizes the Contest Organizer and its representatives to use, if required, their name, address (city, province), voice, statements, photography, image and other representations and recordings, for advertising purposes, in any media, including but not limited to the Internet, without further notice and any form of remuneration.  Any participant may be required to sign a confirmation to this effect.  

Intellectual property and copyright.  By submitting a photograph, musical piece, creation or other type of work (the “Work”) as part of this Contest, the participant warrants that the Work is free of any rights of third parties and the participant warrants having the necessary rights to submit the Work and, in particular, but without limitation, to authorize the Organizer to use, modify, transfer, adapt, broadcast, communicate or distribute the Work, in any broadcast, media or technology whatsoever, including, but without limitation, television, information technology, wireless or online. The Participant agrees to provide, upon request, proof of his or her rights in the Work and indemnifies the Organizer in the event of any claim, demand, lawsuit or dispute arising out of any type of use of the Work.

Ownership. All information and documents related to the Contest, including, but not limited to, entry forms, scratch cards, declaration and liability waiver form, information of a technical, technological or operational nature and information relating to drawings, computer systems, software, logos, trademarks and intellectual property are and remain the exclusive property of the Contest Organizer.  None of this information and documentation will be returned to participants.

Decision of the Contest Organizer.  Any decision of the Contest Organizer or its representatives relating to this Contest shall be final and without appeal, subject to any decision of the Régie des alcools, des courses et des jeux du Québec in connection with any matter under its jurisdiction. 

Dispute / Residents of Quebec. Any dispute respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any dispute respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

Régie des alcools, des courses et des jeux.  The Régie des alcools, des courses et des jeux du Québec is not bound in any way by the Contest and cannot be held responsible in any way for any question relating to the Contest.

Contest rules in English and French. In the event of a conflict between the terms of the Contest Rules in French and the Contest Rules in English, the terms of the Contest Rules in French will prevail.  

Miscellaneous.  By participating in the Contest, participants agree to be bound by these Contest Rules and the decisions of the Organizer, which are final and without appeal in all respects, including, but not limited to, decisions concerning the eligibility or disqualification of the entry forms and the award of a prize. The Contest is subject to all applicable laws and regulations. Only selected participants will be contacted.  If a paragraph of these Rules is declared illegal or unenforceable by a competent court, then that paragraph shall be considered null and void, but all other paragraphs shall remain applicable..
